Google will have to turn over every record of every video watched by YouTube users, including users' names and IP addresses, to Viacom, which is suing Google for allowing clips of its copyright videos to appear on YouTube, a judge ruled Wednesday.
Viacom wants the data to prove that infringing material is more popular than user-created videos, which could be used to increase Google's liability if it is found guilty of contributory infringement.
Viacom filed suit against Google in March 2007, seeking more than $1 billion in damages for allowing users to upload clips of Viacom's copyright material. Google argues that the law provides a safe harbor for online services so long as they comply with copyright takedown requests.
Although Google argued that turning over the data would invade its users' privacy, the judge's ruling (.pdf) described that argument as "speculative" and ordered Google to turn over the logs on a set of four tera-byte hard drives.
The judge also turned Google's own defense of its data retention policies -- that IP addresses of computers aren't personally revealing in and of themselves, against it to justify the log dump.
The Electronic Frontier Foundation has already reacted, calling the order a violation of the Video Privacy Protection act that "threatens to expose deeply private information."
The order also requires Google to turn over copies of all videos that it has taken down for any reason.
Viacom also requested YouTube's source code, the code for identifying repeat copyright infringement uploads, copies of all videos marked private, and Google's advertising database schema.
Those requests were denied in whole, except that Google will have to turn over data about how often each private video has been watched and by how many persons.

OPEC Chief Abdallah el-Badri warns that Iran's oil output would be difficult to replace if an attack took place on the Islamic Republic.
The secretary general of the Organization of Petroleum Exporting Countries told the daily newsletter of the World Petroleum Congress on Thursday: "If something happened in Iran, it would be difficult to replace 4.2 million barrels a day . . . the price (of crude) will go up of course."
Badri's remarks came after Israeli military exercise early in June, which was widely viewed as rehearsal for a potential strike on Iran's nuclear installations.
Oil surged past $145 per barrel for the first time on Thursday due to the depreciating US dollar and tension in the Middle East.
When asked about fears that Iran would close the straits of Hormuz in the Persian Gulf if attacked, he replied that if engaged in a war a country may use any strategy to win.
Hormuz is a key shipping route through which 40 percent of Middle Eastern oil supplies pass.
On Wednesday, the Iranian oil minister warned that a military action against Iran would provoke an unimaginably fierce reaction from the country.
Gholam-Hossein Nozari said that Iran's reaction to any attack on the country would spike oil prices in an already unstable market.

A licence to create human-pig embryos to study heart disease has been issued by the fertility watchdog.
This marks the third animal-human hybrid embryo licence to be issued by Human Fertilisation and Embryology Authority and the first since the Commons voted in favour of this controversial research last month.
An HFEA spokesman said it had approved an application from the Clinical Sciences Research Institute, University of Warwick, for the creation of hybrid embryos. The centre has been offered a 12 month licence with effect from today, July 1.
The effort at the University of Warwick is led by Professor Justin St John. "This new license allows us to attempt to make human pig clones to produce embryonic stem cells," he said, where embryonic stem cells are able to turn into the 200 plus types in the body.
"We will take skin cells from patients who have a mutation for certain kinds of heart disease (cardiomyopathy, which makes the heart lose its pumping strength) and put them into pig eggs after their chromosomes have been removed. We will then make embryos so that we can attempt to derive embryonic stem cells which will allow us to study some of the molecular mechanisms associated with these heart diseases.
"Ultimately they will help us to understand where some of the problems associated with these diseases arise and they could also provide models for the pharmaceutical industry to test new drugs. We will effectively be creating and studying these diseases in a dish.
"But it's important to say that we're at the very early stages of this research and it will take a considerable amount of time. There is still a great deal to learn about these techniques and much of our early work will involve understanding how we can make the hybrid cloning process as efficient as possible."
The study is aimed at understanding the way power-producing structures in cells, called mitochondria, are passed from egg to embryo. In the hybrid, the mitochondria mostly come from the egg, initially making up around half of the DNA by weight, and the team will do experiments in order to ensure that the trace of human mitochondrial DNA takes over, not least because it is designed to work with human nuclear DNA.
"The key thing we are doing is trying to create stem cells without any animal DNA in them. So even though these hybrid embryos normally have a small percentage of animal DNA , we are hoping to create cells that would have human chromosomes and human mitochondrial DNA." The reason is that, as the team puts it, "mixing of these two diverse populations of mitochondria can be detrimental to cellular function."
Dr Evan Harris, Liberal Democrat science spokesman, commenting on the HFEA decision to issue a license to the University of Warwick to create hybrid embryos combining human skin cells with enucleated pig eggs, said: "This application is a further indication of the interest in this sort of research by UK scientists, the decision of the HFEA to issue a license following stringent checks demonstrates that it is considered both necessary and ethical."
"While this approval comes under the existing 1990 Human Fertilisation and Embryology Act, both houses of Parliament have recently voted by large majorities to allow it into the future," said Prof Robin Lovell-Badge, of the MRC National Institute For Medical Research.
"It is good news that this license has been issued at a time when parliament has expressed overwhelming support for this research after an excellent public debate. I suspect other similar applications will follow and hopefully this research can now progress without the hype."
Teams in Newcastle and London are already creating hybrids. The former have already created hybrids with cow eggs to study the basics of how the use of genes changes in early development, the latter a range of species to generate stem cells from people with neurodegenerative disorders.

Future referendums will be ignored whether they are held in Ireland or elsewhere, Valéry Giscard d'Estaing (Knights of Malta), the architect of the European Union Constitution said.
The former President of France drafted the old Constitution that was rejected by French and Dutch voters three years ago before being resurrected as the Lisbon EU Treaty, itself shunned by the Irish two weeks ago.
Mr Giscard d'Estaing told the Irish Times that Ireland's referendum rejection would not kill the Treaty, despite a legal requirement of unanimity from all the EU's 27 member states.
"We are evolving towards majority voting because if we stay with unanimity, we will do nothing," he said.
"It is impossible to function by unanimity with 27 members. This time it's Ireland; the next time it will be somebody else."
"Ireland is one per cent of the EU".
Mr Giscard d'Estaing also admitted that, unlike his original Constitutional Treaty, the Lisbon EU Treaty had been carefully crafted to confuse the public.
"What was done in the [Lisbon] Treaty, and deliberately, was to mix everything up. If you look for the passages on institutions, they're in different places, on different pages," he said.
"Someone who wanted to understand how the thing worked could with the Constitutional Treaty, but not with this one."
France and Germany are putting pressure on Ireland to hold a second referendum which would allow the Lisbon Treaty to come into force before European elections on June 4 2009.
Mr Giscard d'Estaing believes "there is no alternative" to a second Irish vote, a view shared by Nicolas Sarkozy, the French President.
Mr Sarkozy, who takes over the EU's rotating presidency next week, will use a Brussels summit on October 15 to force Ireland to find a way out of Europe's Treaty difficulties.
"Everyone agrees it has to be sorted out by the time of European elections," he said at the weekend.
Václav Klaus, the Czech President has continued to insist that the Lisbon Treaty "cannot come into force" after the Irish vote.
"The EU cannot ignore its own rules. The Lisbon Treaty has been roundly and democratically rejected by Ireland, and it therefore cannot come into force," he told El Pais newspaper.
"Any attempt to ignore this fact and make recourse to pressure and political manipulation to move the treaty forward would have disastrous consequences."
Mark François, Conservative spokesman on Europe, also insisted that it was time that European politicians started to respect the Irish No vote.
"The Irish people gave an emphatic No to the Treaty of Lisbon on a record turnout and it would be good for politicians of all countries to respect this democratic decision," he said.
"The point is particularly clear to us here in Britain as the Irish were fortunate to be given a referendum which we were denied by our Government."
An opinion poll for the newspaper Libération has shown 44 per cent of the French want Ireland to vote again and 26 per cent want the ratification process to continue without Ireland.
But a quarter of those polled want to abandon the Treaty and 52 per cent think the Irish No vote is going to dominate Mr Sarkozy's EU presidency.

An Iranian commander says the global community turned a blind eye to the downing of a passenger jet by the US navy in the Persian Gulf.
The Deputy Head of Iran's Armed Forces Headquarters, Brigadier General Seyyed Masoud Jazayeri, said Saturday that July 3 is a 'shameful day' for the so-called US democracy.
Iran Air Flight 655 was destroyed by the US Navy's guided missile cruiser USS Vincennes between Bandar Abbas and Dubai on Sunday July 3, 1988, over the Strait of Hormuz.
The US warship patrolling Iran's maritime territory killed all 290 passengers, including 66 children, and crewmembers.
The White House claims the incident was an honest mistake on behalf of the US Navy. Iran, however, says there is no way that an Airbus A300 can be mistaken for an F-14 Tomcat fighter.
"What is most disgraceful and shameful is that the criminal commander of the ship was awarded the Legion of Merit medal," Gen. Jazayeri continued.
Lieutenant Commander Scott Lustig, air-warfare coordinator on the Vincennes, received the Commendation Medal for 'heroic achievement', noting his 'ability to maintain his poise and confidence under fire' that enabled him to 'quickly and precisely complete the firing procedure'.
The Iranian commander added that the UN Security Council did not take reasonable measures against the US over targeting the civilian aircraft within Iranian airspace.
Gen. Jazayeri called on the international community to never forget Washington's atrocities in the Persian Gulf, the US government's refusal to claim responsibility for the incident, and its refusal to apologize to the Iranian nation.
Ron Paul gave a speech on the House floor today condemning the "virtual war resolution" soon to be considered by the House of Representatives. This bill already has 208 co-sponsors, and will likely be voted on after the 4th of July holiday. A related bill is being worked on in the Senate, with 29 Cosponsors. Many of the cosponsors are Democrats. Who says the Democratic Party is the anti-war party? Gore Vidal, US novelist, historian and social critic says the Bush regime has killed all of the constitutional links that made the US a republic.
On early Friday morning Iran time, in an exclusive interview with Press TV, Vidal said that President Bush has rid the country of the Bill of Rights, habeas corpus and the entire legacy of the Magna Carta in the name of war on terror.
He also criticized the House of Representatives for not impeaching President Bush, over a wide array of subjects such as disclosure of CIA agent Valerie Plame's covert status. Vidal did however single out Rep. Dennis Kuchinich for drawing up articles of impeachment against the president.
Vidal, long strongly critical of the Bush administration, said the administration has both an an explicit and covert expansionist agenda.
In his writings he has made the assessment that for several years, the administration and its associates, many of whom are magnets in the oil and gas industry have had clear aims to control the oil of Central Asia which is to follow on the heels of gaining effective control of the oil of the Persian Gulf--a project that took a new twist with the Iraqi invasion of Kuwait in 1991.

Just imagine, Gordon Brown and David Milliband, "Off with his head!". That is however the reality of the situation. So for the Queen herself to willingly and knowingly, sign away her crown and kingdom is beyond belief. Why is no one in the streets? Is the government's propaganda(lies, doublespeak) that good? Obviously.
This unelected, unaccountable EU elite will not give up however. They wanted a constitution, we said no. So they called it a treaty, can we be fooled that easily! No matter, we can have no say anyway. Don't forget NOBODY has can read it (the treaty was handed out as a list of amendments, not a comprehensive document. The EU commission refused to print a full merged copy until after ratification had taken place?!). Deceit at it's inception. It will be deceit to the end as it comes into play 1st January 2009.
While Irish Prime Minister Brian Cowen is "looking at options", hopefully the grassroots campaign that helped Ireland produce a no vote, will be able to withstand the propaganda campaign which is sure to besiege their nation.

As an after thought. Those who have done more research will know by 2010 the NAU or North American Union (Canada, US, Mexico) will be in effect. The AU(African Union est 2002) is already here and the Asian Union and Pacific Union are fast approaching. It's obvious what the next union will be. During a conference on C-Span, Ron Paul was asked to evaluate Obama in light of his nomination. He does this quite eloquently, highlighting the fact that most Americans do not know the issues. I agree. They're hooked on chanting the talismanic slogan of "change", without knowing a single policy he plans to implement. Believe me most Americans don't. Understandable considering the Bush, Clinton, Bush and almost Clinton again administration they've just had to suffer. To expand a little and show the magnitude of this, the Federal Reserve 2008 accounts say they're already in a 40 trillion dollar obligation to healthcare. That's not a spelling mistake. Surely Obama know's this? The Federal Reserve is already printing 20 billion dollars a year (out of thin air) and taking loans secured against sub prime securities to fund a trillion dollar a year war. How is it going to cope with the baby boomers who are now of age and which the 40 trillion owed? Obama knows. Universal healthcare! That's just one of his policies.
